The Whistleblower legislation that was campaigned on and repeatedly promised by Premier and Minister for Finance Hon. Andrew Fahie is expected to make provision for an employee working in the private sector as well as in Government, to be afforded protection for exposing illegal activities within their organization.
Whistleblower law provides cover for an individual who reveals information that is deemed illegal, unethical, or not correct within an organization and exists on the law books of many countries. The most popular is the United States of America’s Whistleblower Protection Act. This Act was made into federal law in 1989, and it is currently at the heart of the impeachment inquiry against President
Donald Trump.
It is a norm for Whistleblower legislation to include both the public and private sector. Feature. However, previous mention of the proposed Bill mainly focused on the public aspects of it. The mention of the private sector component was recently made by His Excellency Governor Augustus Jaspert in the Speech from that was delivered on November 14.
As part of the legislative announcements the Governor made mention of the Whistle Blower Bill. His Excellency stated, “Our Government remains committed to good governance, transparency, and accountability and will work towards the Whistleblower Legislation to cover both the public and private sectors.”
During his campaign in January, Premier
Fahie promised that once elected his government was going to move to have such a legislation in place. The Premier noted at that time that the Whistleblower legislation is expected to protect public servants who report wrongdoing in government.
He gave an update on this promise during the House of Assembly sitting on September 2. Hon.
Fahie announced that Attorney General Hon. Baba Aziz has been asked to move forward with efforts to have a Whistleblower Bill for the Territory.
“Just this morning I have written to the Attorney General’s Chambers asking for the Whistle Blowing legislation stating that it is needed now more than ever. The legislation must be Territory wide as it is needed to guard employees against the elected members of government, the Governor, the public service, the private sector,” the Premier stated.
