The Andrew Fahie-led regime is making strides to modernise the territory’s existing Labour Code 2010, to bring it “more in line with the current VI labour market and industry standards.”

This was one of the decisions coming out of the March 17, 2021, Cabinet meeting chaired by His Excellency, the Governor Mr John J. Rankin, CMG.

The meeting was held at the Financial Services Commission’s Conference Room where all members of Cabinet were present.

Michele Tiraboschi to be hired as consultant


The Cabinet Decisions released on the Government’s website on Thursday, March 25, 2021, stated that Cabinet “decided that the Government engage Mr Michele Tiraboschi, as a consultant, to work on a collaborative basis with the Attorney General’s Chambers to undertake the review of the Labour Code, 2010.”

Local government also agreed to pay Mr Tiraboschi, $24,000 for the consultancy, which took effect on March 24, 2021.

According to our research, Mr Tiraboschi is a Full Professor of Labour Law at the University of Modena and Reggio Emilia, Italy, and is the author of many publications. He is known for his participation in national debates on Italian labour market reforms and for his research in labour law.

‘Simplified’ Labour Code


The consultancy also requires Mr Tiraboschi to provide the Ministry of Natural Resources, Labour and Immigration with a draft revised and simplified Labour Code for the Virgin Islands; a draft Labour Regulations for construction and marine Industries; and finally, a National Organisation Health and Safety regulation according to the International Labour Organisation standards.

Another decision was also made relating to waiving work permit for consultants like Mr Tiraboschi, the document stated.

“Decided that Part X (Work Permits) of the Labour Code, 2010 shall not apply to consultants engaged by the Government of the Virgin Islands and statutory bodies established by it for the duration of their engagement in the Virgin Islands.”
