Employment Tribunal Reviews Use of Female Changing Room by Transgender Doctor
NHS Fife's equality policy upheld as nurse claims unlawful harassment after sharing facilities with Dr. Beth Upton.
An employment tribunal has begun hearings to determine the circumstances surrounding the use of a female changing room by Dr. Beth Upton, a transgender doctor, at Victoria Hospital, Kirkcaldy, owned by NHS Fife.
The tribunal emerged following a complaint filed by nurse Sandie Peggie, who claims her treatment amounted to unlawful harassment under the Equality Act after sharing the changing room with Dr. Upton.
Esther Davidson, a clinical nurse manager at NHS Fife, provided testimony supporting Dr. Upton's right to access female changing facilities in accordance with the health board's equality and diversity policy.
Davidson stated that after consulting NHS Fife's equality and diversity lead, she was informed that Dr. Upton identified as a woman and thus had the right to use the women’s changing room.
Davidson initially led an investigation into a separate complaint made by Dr. Upton regarding alleged bullying and harassment by Ms. Peggie.
This investigation was later reassigned to prevent a potential conflict of interest, given Davidson's role as a witness in the case.
The dispute escalated on Christmas Eve 2023, when Ms. Peggie expressed strong objections to Dr. Upton being in the women’s changing room, asserting the belief that Dr. Upton was a man.
Davidson noted the situation was distressing for both parties and emphasized that various female staff members often chose to use cubicles to change rather than share open changing areas.
In response to the ongoing tensions, Ms. Peggie was placed on special leave shortly after the Christmas incident to mitigate potential conflicts while an investigation was undertaken.
Following this, she was temporarily suspended on January 3, 2024, after the human resources department resumed operations post-holiday season.
During the tribunal, Davidson recognized Ms. Peggie's ability to express her views but clarified that her understanding of gender identity did not align with Ms. Peggie's perspective.
The tribunal proceedings are ongoing as both sides present their arguments and evidence.
